CHANGES TO DISCLOSURE & BARRING CHECKS – REMOVAL OF SUPERVISION EXEMPTION

As a result of the Crime and Policing Act 2026, there has been an important change to who is required to have an Enhanced DBS Check against the children’s barred list. This change came into effect on 1st September 2026.

This change means that a small number of people who previously did not meet the requirements now do so.

Anyone who meets the following requirements is required by law to have an Enhanced DBS Check against the children’s barred list:

  • Teaching, training, instructing, or caring for or supervising children.

and

  • Doing so for 3 days or more in a 30-day period or overnight.

The supervision exemption has been removed; however, the role and frequency elements have not changed.

All organisations are encouraged to check if anyone in their workforce is affected. Further guidance is available via the BF webpage about criminal record checks here.

More details on the changes are provided by the Disclosure and Barring Service.
